Conference 2012

On September 15, 2012 
at National University "Odessa Law Academy" in collaboration with Southern Regional Center of National Academy of Legal Sciences of Ukraine and Committee of Verkhovna Rada on Justice   in the assembly hall of the Academic Council of  National University "Odessa Law Academy" was held an international research and practice conference "Legal groundwork for effective execution of a decision and practice of the European Court of Human Rights" within research project headed by Academician Sergei Vasilievich Kivalov.

The scientific forum workshop was attended by leading experts in execution of a decision and implementation of practice of the European Court of Human Rights in the rule-making and enforcement activities; experts from Ukraine and other countries.

Participants of the Conferencewere congratulated by the President of Ukraine V.F. Yanukovych, Verkhovna Rada Chairman V.M. Litvin, Minister of Foreign Affairs of Ukraine K.I. Grishchenko, Chairman of the Supreme Court of Ukraine P.P. Pilipchiuk.

At the plenary session presentations were made by the judges of the European Court of Human Rights David Thor Bjorgvinsson (Iceland), Khanlar Gadjiiev (Azerbaijan), Judge of the European Court of Human Rights in retirement, Legum Doctor (LL.D.), Professor, member of the Constituent Assembly under the President of Ukraine Vladimir Butkevitch, Judge of the European Court of Human Rights ad hoc, professor of Department of Public Law Sciences, National University of "Kyiv-Mohyla Academy", Doctor of Law, a corresponding member of National Academy of Legal Sciences of Ukraine Stanislav Shevchuk, head of the Center for Human Rights and Humanitarian Law at the University Panthéon-Assas ( Paris II) Professor Emmanuel Decaux (France), member of the Committee for Human Rights and Legal Affairs of the Parliamentary Assembly of the Council of Europe Mevlut Chavushoglu (Turkey), UNHCR Regional Representative in Belarus, Moldova and Ukraine Andrysek Oldrich (the Netherlands), Professor of International Law and International Relations at the National University "Odessa Law Academy", Doctor of Law, Professor Natalia  Zielinska, a Professor of International Law Department of Taras Shevchenko National University of Kiev, LL.D. The conference program included more than 60 reports on burning issues of the practice implementation of the European Court of Human Rights and exercise of its decisions as a key element of the European system of protection of human rights and fundamental freedoms.

At  the plenary session and two round table meetings were discussed topical issues of restructuring the European system of Human Rights Protection, the impact of structural and systemic deficiencies of legal systems of the States Parties to the Convention for the Protection of Human Rights and Fundamental Freedoms on the implementation of the decisions and the practice implementation of the European Court of Human Rights; Legal groundwork for effective execution of decisions of the European Court of Human Rights;  Legal groundwork for effective implementation of practice of the European Court of Human Rights

Suggestions of the participants of the conference were summarized in the resolution, which focused attention on the fact that the viability of the system of the Convention on the Protection of Human Rights and Fundamental Freedoms falls within the scope of joint responsibility of the European Court of Human Rights and Countries-Members.

Among the key recommendations stated in Resolution must be emphasized a suggestion to establish a common database of cases under consideration in Court, individual applications and all decisions of the Court and information about their performance, establishment of non-governmental centers of application analysis,  introduction of the institution of collective (not individual) statements in case of systematic violations of the Convention, providing the possibility of direct constitutional appeal for individuals, providing a sufficient number of employees of the Registry and posted lawyers (secondees), dissemination of diplomatic immunity and privileges to the judges of the ECHR and their family members to maintain their privacy.

Also, the participants of the conference developed sugesstions forVerkhovna Rada of Ukraine to establish a special parliamentary commission with the participation in it of People's Deputies of all deputy factions, judges of the different jurisdictions, academicians and representatives of civil society organizations to improve legislation on the implementation of the decisions and the application of the European Court of Human Rights; to regulate the ratio of the norms of international and domestic law, to eliminate the contradiction between the Regulations of the Constitution and laws of Ukraine on the effect of international law.

Conference participants admitted the special role of the European Court of Human Rights in the functioning of the European System of Human Rights Protection, which is a unique legal system of universal values based ​​on the indisputable authority of the Court and on the impact of its decisions on the national legal system.


A collection of reports was publicated according to the results of the scientific workshop.
