The Second International Scientific Conference “Legal Ensuring of Effective Execution of Judgments and Implementation of Practice of the European Court of Human Rights”

The Second International Scientific Conference “Legal Ensuring of Effective Execution of Judgments and Implementation of Practice of the European Court of Human Rights” was held under the auspices of the Secretary General of the Council of Europe, Mr. Thorbjørn Jagland, at the National University “Odessa Law Academy” on September 20-21, 2013. The Conference was organized jointly by the University and the Committee on the Rule of Law and Justice of the Verkhovna Rada of Ukraine and the South Regional Centre of the National Academy of Legal Sciences of Ukraine. This year the Conference was dedicated to the 60th Anniversary of coming into force of the 1950 Convention for the Protection of Human Rights and Fundamental Freedoms.
The Head of the Organizing Committee is Mr. Serhii Kivalov, the Head of the Committee on the Rule of Law and Justice of the Verkhovna Rada of Ukraine, a member of the Committee on Legal Affairs and Human Rights of the Parliamentary Assembly of the Council of Europe, a member of the Venice Commission, the President of the National University “Odessa Law Academy”, Doctor of Legal Sciences, Professor, Academician of the National Academy of Legal Sciences of Ukraine.

Famous politicians, scholars, professional experts from Azerbaijan, Armenia, Germany, Poland, the Russian Federation, the USA, Turkey, Ukraine and other states took part and greatly contributed to the work of the scientific forum. The field of their expertise is legal ensuring of the effective execution of the ECHR judgments and ensuring of the effective implementation of the ECHR practice in legislative and law-enforcement activity. 

Amongst the guests of honour at the Conference there were: Mr. Jean-Claude Mignon, the President of the Parliamentary Assembly of the Council of Europe; Mrs. Alvina Gyulumyan (the Republic of Armenia), Mrs. Ganna Yudkivska (Ukraine), Mr. Dmitry Dedov (the Russian Federation), judges of the ECHR; Mr. Mevlut Chavushoglu, a member of the Committee on Legal Affairs and Human Rights of the Parliamentary Assembly of the Council of Europe, the Committee on Political Affairs of the Parliamentary Assembly of the Council of Europe, a deputy of the Grand National Assembly of Turkey, the former President of the Parliamentary Assembly of the Council of Europe; Mr. Igor Sagach, Roving Ambassador of the Ministry of Foreign Affairs of Ukraine; Mr. Oldrich Andrysek, the UNHCR Regional Representative for Belarus, Moldova and Ukraine; Mr. Vladimir Ristovski, Representative of the Secretary General of the Council of Europe in charge of the coordination of the Council of Europe cooperation programmes with Ukraine, Head of the Council of Europe Office in Ukraine; Mr. Marc Bojanic, the UN Office Human Rights Advisor in Ukraine; Mrs. Nur Sagman, Consul General of the Republic of Turkey in Odessa; Mr. Eduard Matviichuk, the Governor of the Odeesa Oblast.

The official languages of the Conference are Ukrainian, Russian, and English.

The Conference got together like-minded persons who understand the importance of development of the national legal systems of State parties to the Convention for the Protection of Human Rights and Fundamental Freedoms in the direction of its provisions. Participation in the work of the Conference of judges of higher judicial organs of Ukraine (the Constitutional Court of Ukraine, the Supreme Court of Ukraine, the High Specialized Court of Ukraine for Civil and Criminal Cases, the High Administrative Court of Ukraine), who participate directly in implementation of both norms of the Convention and respective practice of the ECHR in Ukraine, was of a special significance.

Mr. Serhii Kivalov, Doctor of Legal Sciences, Professor, Academician of the National Academy of Legal Sciences of Ukraine, the President of the National University “Odessa Law Academy”, the Head of the Committee on the Rule of Law and Justice of the Verkhovna Rada of Ukraine, opened the Second International Scientific Conference “Legal Ensuring of the Effective Execution of Judgments and Implementation of Practice of the European Court of Human Rights”.

Mr. Jean-Claude Mignon, the President of the Parliamentary Assembly of the Council of Europe, and representatives of the diplomatic corps made welcoming speeches to the participants of the Conference. 

The Opening Plenary Session included the following speeches: Mrs. Alvina Gyulumyan, a judge of the ECHR, “Positive Obligations of the State – Procedural Aspects”; Mrs. Ganna Yudkivska, a judge of the ECHR, “16 Years under the Jurisdiction of the European Court of Human Rights – Some "Intermediate" Outcomes”; Mr. Dmitry Dedov, a judge of the ECHR, “Dynamism in the Practice of the ECHR Guarantees Punishment on the Basis of the Law”; Mr. Vyacheslav Tulyakov, an ad hoc judge of the ECHR (Ukraine), Professor at the National University “Odessa Law Academy”, Doctor of Legal Sciences, a corresponding member of the National Academy of Legal Sciences of Ukraine, “Protection of Victims of Crimes in the European Legislation and the Practice of the ECHR”; Mr. Nikolay Korotkevich, a judge of the Supreme Court of Ukraine, “Effective Mechanisms of Execution of the European Court of Human Rights Judgments as an Effective Means of Elimination Structural Deficiencies in the Aspect of the Supreme Court of Ukraine”; Mr. Alexey Moiseev, the Vice-president of the Russian Association of International Law, the Dean of the Faculty of International Law at the Diplomatic Academy of the Ministry of Foreign Affairs of the Russian Federation, Doctor of Legal Sciences, “International Legal Standards of Human Rights and Fundamental Freedoms and the National Legal System”; Mr. Pavel Biriukov, Professor at Voronezh State University, Doctor of Legal Sciences, “Judgments of the European Court of Human Rights in Austria, Spain and the Russian Federation”; Mr. Stefan Kirsch, a member of the Committee on European Law of the German Federal Bar (Bundesrechtsanwaltskammer), Attorney, “The Exhaustion of Domestic Remedies and the Role of the Constitutional Court in Germany”; Mrs. Bożena Gronowska, Professor at Nicolaus Copernicus University (Toruń, Poland), “Effectiveness of the European Court of Human Rights’ Judgments in Poland – Normative and Practical Aspects”; and many others.

More than a hundred of participants and guests had a chance to participate in discussion on the most urgent matters related to legal ensuring of the effective execution of judgments and implementation of practice of the European Court of Human Rights:

- on implementation of practice of the European Court of Human Rights (in particular, principles of practice formation of Strasbourg Court; means of ensuring of legal definiteness and consistency of Strasbourg Court’s practice; evolutionary character of the Convention and dynamism of the practice of Strasbourg Court; technique of implementation of the ECHR practice (problems of availability, translation, selection of the ECHR practice); a role of the ECHR practice in the system of legal sources of the Council of Europe and national legal sources; state policies and mechanisms of implementation of Strasbourg Court’s practice);
- on execution of the ECHR judgments and taking measures of a general and individual character (particularly, international legal standards of human rights and fundamental freedoms and national legal systems; national mechanisms of execution of the Court’s judgments in State parties to the Convention concerning measures of a general character; effective mechanisms for execution of the ECHR judgments as an effective means to eliminate structural deficiencies).

The Conference resulted in publication of the Collection of the Conference Materials, which consists of more than 40 scientific articles.

In the end of the Conference proposals of participants of the Conference regarding the legal ensuring of the effective execution of judgments and implementation of the practice of the ECHR were systematized in the form of the final resolution.
